I had an agreement with a collection agency, now they are suing me?

You can be sued if you are also on the same health insurance policy because you are both jointly and severally liable for debts incurred while married. If you go to court, they may not get everything they are suing for.They can certainly try. Married couples can be found liable for each others debts. What does your divorce decree say? Does it specifically mention this debt or include this debt within others named?
The fact that you have been making payments assumes you have admitted or taken responsibility for the debt. That could work against you.
It is a common, false belief that as long as a person makes payments, regardless of how small, that they cannot be sent to collection agency or sued. Unless the amount of the re-payment is agreed upon by both parties, it does not have to be accepted.
Collection agencies use many scare tactics to get larger lump sum final payments. They very well may take you to court. You may get a judgment against you for larger payments or any other decision the judge decides. May go in your favor, may not.The divorce is between you, him, and the judge. It does not stop the doctor, the collection agency, or anyone else who was not part of the divorce from doing anything that they could otherwise do. However, after you pay it, you might be able to sue your ex.Yes….medical collectors tend to be very aggressive.
Are you sure you’re being sued? Have you officially been served a summons to appear in court for this debt by a sheriff or process server that included a court case docket number ? Has a court date been set? A letter from a collection agency implying legal action is not a summons.
